Distance Sales Agreement

This Distance Sales Agreement (the “Agreement”) has been concluded electronically between the following parties:

The subject of this Agreement is to determine the rights and obligations of the parties in relation to the sale and delivery of the lighting products, whose characteristics and sale price are specified below, ordered electronically by the BUYER through the SELLER’s website.

4.1. The BUYER acknowledges that they have been informed in advance of the essential characteristics of the product subject to the Agreement, its sale price, the payment method and the delivery details, and that they have given the necessary approval electronically.

4.2. The product subject to the Agreement shall be delivered within the period stated on the website depending on the BUYER’s place of residence, provided that this does not exceed the legal period of 30 days.

4.3. If the product is to be delivered to a person/organisation other than the BUYER, the SELLER cannot be held responsible if the person to whom it is to be delivered does not accept the product.

4.4. The SELLER is responsible for delivering the product in sound condition, complete and in accordance with the characteristics specified in the order.

4.5. The BUYER is obliged to inspect the product before accepting delivery. Damaged or defective products should not be accepted from the courier.

5.1. Right of Withdrawal: The Buyer has the right to withdraw from the Agreement (return the product) within 14 (fourteen) days from the date of receipt of the product, without giving any reason and without paying any penalty.

5.2. Return Conditions and Condition of the Product: Products to be returned must be delivered complete and undamaged, together with their original box, packaging, standard accessories (if any) and invoice. If the product has been used in a way that reduces its commercial value, has been installed (e.g. connected to the electrical supply) or its original packaging has been damaged, the return may not be accepted or a deduction may be made from the price of the product in proportion to the loss in value.

5.3. Cases in Which the Right of Withdrawal Does Not Apply: Pursuant to Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for products prepared in line with the Buyer’s requests or personal needs (products made in colours outside the standard catalogue, with a name/logo added, or with dimensions specially modified for the Buyer). 3D-printed products of standard design fall outside this scope. Standard colours: Chinese Red, RGB Blue, Silk Black, Emerald, Peak Green, Soft Blue, Magenta. Colours other than the standard colours are catalogue colours and are specially pigmented. In addition, products that have been installed and can no longer be resold, and lighting products that have been connected to the electrical supply and used, are also outside the scope of the right of withdrawal.

5.4. Return Shipping: For returns made under the right of withdrawal, the outbound and return shipping costs of the product are borne by the customer. The remaining amount is refunded after these costs have been deducted.

5.5. Commercial Purchases: The right of withdrawal under this Agreement applies only to individual consumers. For purchases made for commercial or professional purposes (invoiced to a company, bulk projects, etc.), the provisions of the Turkish Commercial Code apply and the right of withdrawal without reason cannot be exercised.

5.6. Damaged Delivery and Damage Report: If the parcel received shows externally visible damage (crushing, breakage, wetness), the Buyer is obliged to have the courier draw up a "Damage Assessment Report" (Hasar Tespit Tutanağı). Responsibility for notifications of damaged products for which no such report has been drawn up lies with the Buyer.

5.7. Right of Unilateral Cancellation: Nazze Studio reserves the right to cancel the order unilaterally and refund its price in the event of a technical error, the product being out of stock, a content/service issue, a payment security issue, or suspicion of abuse/bad faith.

6.1. The BUYER may make payment by credit card, bank transfer or the other payment methods offered on the website.

6.2. For payments made by credit card, the order is not deemed valid unless the payment is approved by the relevant bank.

6.3. The SELLER has the right to inform the BUYER regarding products that are out of stock.

7.1. All lighting products sold are covered by the manufacturer’s warranty.

7.2. Faulty products covered by the warranty are repaired or replaced free of charge.

7.3. Faults caused by user error are not covered by the warranty.

8.1. Electrical damage that may arise from the incorrect use of the products is the responsibility of the BUYER.

8.2. The BUYER is obliged to have the products installed by qualified persons.

The SELLER uses the BUYER’s personal data solely for the purpose of carrying out the order process and fulfilling its legal obligations. This data is shared only with the organisations that provide us with payment, shipping and invoicing services, and with legally authorised authorities, to the extent necessary for this purpose; details can be found in the Privacy Policy.

In the event of a dispute, the Consumer Arbitration Committees and Consumer Courts at the BUYER’s place of residence have jurisdiction, within the monetary limits determined by the Ministry of Trade.

By placing an order through the website, the BUYER is deemed to have accepted all the terms of this Agreement.
